Product Representation and Allergies: All images shown on our website or any other platform are for indicative purposes only and may not represent the actual product due to variations in preparation and delivery. Our products are prepared in a facility that handles common allergens, including but not limited to milk, eggs, wheat (gluten), soy, peanuts, tree nuts, and sesame. While we take precautions to prevent cross-contamination, we cannot guarantee that any product is completely free of allergens. It is the customer's responsibility to inform us of any allergy in advance of placing an order.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Dessert Avenue reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Dessert Avenue confirms acceptance, which occurs upon the delivery or collection of your order. Please review your order carefully before submitting, as Dessert Avenue may be unable to accommodate cancellation requests after an order is accepted. An order cannot be canceled if we have already begun preparing it. Orders placed and then cancelled without notice may result in your account being restricted from placing future orders.

Your purchases are subject to return or exchange solely in accordance with our separate Refund Policy.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We strive to ensure all products are delivered fresh. To maintain product quality, food preparation begins when your order is ready to be dispatched for delivery or collection.

Customer Responsibility for Delivery:

  • It is the customer's responsibility to provide a correct and complete delivery address. An incorrect address may incur additional delivery charges.

  • For orders delivered to a building with multiple flats, the customer is responsible for coming down to the main entrance to collect the order from the delivery driver.

  • The delivery driver may require access to the building's main entrance or gate to complete the delivery. The driver is not authorized to enter a private home, room, or flat.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, and images, are owned by Dessert Avenue, its affiliates, or licensors and are protected by intellectual property laws.

SECTION 7 - OPTIONAL TOOLS & THIRD-PARTY LINKS

You may be provided with access to customer tools offered by third parties. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties or endorsements. The Services may also contain hyperlinks to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access.

SECTION 8 - PROHIBITED USES & CUSTOMER CONDUCT

You may access and use the Services for lawful purposes only. We have a zero-tolerance policy for abuse or misconduct towards our staff and delivery drivers. Any form of harassment, intimidation, or inappropriate behavior may result in your account being restricted from placing future delivery or collection orders with us.

In addition, you agree not to: (a) engage in any unlawful or malicious purpose; (b) infringe upon our intellectual property rights or the rights of others; (c) harass, abuse, insult, or harm any of our employees or any other person; or (d) upload or transmit viruses or any other type of malicious code.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Dessert Avenue is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Dessert Avenue. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Dessert Avenue.
